Acceptance of Our Terms
The Deakin Centre for Advanced Food Sciences Online Portal is provided to you free of charge by Compusense Inc. under these Terms. These Terms govern your use of and involvement in the Deakin Centre for Advanced Food Sciences Online Portal (whether you are a member or a visitor). These Terms also govern all services provided to you by Deakin Centre for Advanced Food Sciences in connection with the online portal.
Amendments
We may update these Terms from time to time, and any changes will be notified to you via the email address provided by you upon your initial registration or via a suitable announcement on the Deakin Centre for Advanced Food Sciences Online Portal message board. The changes will apply to the use of Deakin Centre for Advanced Food Sciences Online Portal after we have given notice. If you do not wish to accept the new Terms you should not continue to use Deakin Centre for Advanced Food Sciences Online Portal or participate in any of our future projects. If you continue to use the Deakin Centre for Advanced Food Sciences Online Portal after the date on which the change comes into effect, your use indicates your agreement to be bound by the new Terms.
Deakin Centre for Advanced Food Sciences may modify or discontinue the Deakin Centre for Advanced Food Sciences Online Portal with or without notice to you and without liability to you or any third party.
Registration
All persons wishing to become a Deakin Centre for Advanced Food Sciences panellist must be aged 18 years or over and must currently live in Australia.
You will need to register as a Deakin Centre for Advanced Food Sciences member by completing our 5 minute online registration in order to join the Deakin Centre for Advanced Food Sciences Online Portal and access the member’s areas and information.
You must ensure that the details provided by you are about yourself and are correct and complete.
You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in your “Account” page or by contacting us (advancedfoodsciences@deakin.edu.au).
Only one registration for the Deakin Centre for Advanced Food Sciences Online Portal is allowed per person. Any linked child must only be registered once.
Password and Security
When you first register to join the Deakin Centre for Advanced Food Sciences Online Portal you will be given a password. After your first log on to the site you will be able to set your own password. You must keep this password confidential and not disclose it to or share it with anyone. You will be responsible for all activities that occur under your password. If you know or suspect that someone else knows your password you agree to contact us immediately (advancedfoodsciences@deakin.edu.au).
If you forget your password, please contact us (advancedfoodsciences@deakin.edu.au). We will be able to reset your password if you satisfy our security check.
Deakin Centre for Advanced Food Sciences Panel - The Scheme
As a member of the Deakin Centre for Advanced Food Sciences panellist, you will be invited to participate in a variety of surveys and tests. Surveys will occur periodically via an online questionnaire. Occasionally you may be asked to participate in tests at our Burwood facility. When invited to participate in an onsite test, you will be contacted by Deakin Centre for Advanced Food Sciences and be briefed about the process and invited to attend.
You will also be asked to complete a 20-minute questionnaire about your dietary behaviours and food consumption patterns upon signing up to the Deakin Centre for Advanced Food Sciences Consumer and Sensory Database. You will be asked to complete this at the start of each year (January) for every year you remain a member of the database. You will also be encouraged to update your personal details and demographic information each year.
Deakin Centre for Advanced Food Sciences panellists may be removed from the panel at any time at the sole discretion of Deakin Centre for Advanced Food Sciences.
Incentives
We may offer an incentive for a test or series of tests successfully completed online. For these tests the incentive will be communicated in the survey joining instructions.
Intellectual Property
The content of the Deakin Centre for Advanced Food Sciences Online Portal is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the Deakin Centre for Advanced Food Sciences Online Portal on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Deakin Centre for Advanced Food Sciences Online Portal without written permission from Deakin Centre for Advanced Food Sciences.
No licence is granted to you in these Terms to use any trade mark of Deakin Centre for Advanced Food Sciences or its affiliated companies.
Disclaimer of Warranties
The Deakin Centre for Advanced Food Sciences Online Portal is provided on an "as is" and "as available" basis. The Deakin Centre for Advanced Food Sciences Online Portal expressly disclaims all warranties or representations of any kind, express or implied, to the fullest extent permitted by law.
You understand and agree that Deakin Centre for Advanced Food Sciences does not guarantee the accuracy or completeness of any information in or provided in connection with the Deakin Centre for Advanced Food Sciences Online Portal. Deakin Centre for Advanced Food Sciences is not responsible for any errors or omissions or for the results obtained from the use of such information. Neither Deakin Centre for Advanced Food Sciences, its employees or consultants, are engaged in rendering legal, medical, counselling or other professional services or advice. Deakin Centre for Advanced Food Sciences advises you to seek appropriate professional advice or care for any situation or problem that you may have.
Deakin Centre for Advanced Food Sciences shall not be responsible for any loss or damage caused directly or indirectly, by the information or ideas contained, suggested or referenced by the Deakin Centre for Advanced Food Sciences Online Portal. Your participation as a Deakin Centre for Advanced Food Sciences panellist is solely at your own risk. No advice or information, whether oral or written obtained by you from the Deakin Centre for Advanced Food Sciences Online Portal shall create any warranty not expressly made in these Terms or imposed by law.
Deakin Centre for Advanced Food Sciences makes no warranty that the Deakin Centre for Advanced Food Sciences Online Portal will meet your requirements, or that the Deakin Centre for Advanced Food Sciences Online Portal network will be uninterrupted, timely, secure, or error free; nor does Deakin Centre for Advanced Food Sciences make any warranty as to the results that may be obtained from the Deakin Centre for Advanced Food Sciences panel.
You understand and agree that any material and/or data obtained through the Deakin Centre for Advanced Food Sciences Online Portal is at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the involvement with the Deakin Centre for Advanced Food Sciences Online Portal.
Limitation of Liability
Except as required by law, Deakin Centre for Advanced Food Sciences shall not be liable for any indirect, incidental, special or consequential losses or damages or loss of profits, data, goodwill, revenue in each case regardless of whether such losses or damages arise in the normal course of events or whether Deakin Centre for Advanced Food Sciences has been advised of the possibility of such damages.
Deakin Centre for Advanced Food Sciences will not be liable for any such losses or damages whether arising in contract, tort (including negligence) or otherwise arising out of or in connection with this programme.
Termination & Remedies for Breach of these Terms by You
Deakin Centre for Advanced Food Sciences may suspend or cancel your membership or deny you access to the Deakin Centre for Advanced Food Sciences Online Portal immediately at our sole discretion, if you breach any of your obligations under these Terms, or if your use of the Deakin Centre for Advanced Food Sciences Online Portal is inappropriate or otherwise unacceptable.
You can cancel this agreement at any time by informing us in writing. If you are a Deakin Centre for Advanced Food Sciences member you can unsubscribe by using the unsubscribe link on your ‘Account’ page or by contacting us (advancedfoodsciences@deakin.edu.au). If you do so, you must stop using the Deakin Centre for Advanced Food Sciences Online Portal immediately.
Deakin Centre for Advanced Food Sciences shall be entitled to disclose your user identity and details if required or requested by the courts or other law enforcement authorities and/or agencies or in such other circumstances as specified in our Privacy Policy.
Indemnification
You agree to indemnify and hold each of Deakin Centre for Advanced Food Sciences’, its subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the Deakin Centre for Advanced Food Sciences Online Portal or associated tests, the violation of these Terms by you, or the infringement by you, or any other user of your account, or of any intellectual property or other right of any other person or entity.
You may not use the Deakin Centre for Advanced Food Sciences Online Portal for any of the following purposes:
- Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
- Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
- Gaining unauthorised access to other computer systems
- Interfering with any other person's use or enjoyment of the Deakin Centre for Advanced Food Sciences Online Portal
- Breaching any laws concerning the use of public telecommunications networks
- Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner
Deakin Centre for Advanced Food Sciences reserves the right to refuse to post material on the Deakin Centre for Advanced Food Sciences Online Portal or to remove material already posted.
You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgement by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:
- Any claim by any third party that the use of the Deakin Centre for Advanced Food Sciences Online Portal by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice.
- Any claim by any third party that the use of the Deakin Centre for Advanced Food Sciences Online Portal by you infringes that third party's copyright or other intellectual property rights of whatever nature; and any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of Deakin Centre for Advanced Food Sciences Home Panel Tests by you.
Applicable Law
These Terms shall be governed by and construed in accordance with the laws of Australia and any dispute shall be subject to the exclusive jurisdiction of the courts of Victoria.
Miscellaneous
In the event that any provision of these Terms conflict with the law under which these Terms are to be construed or if any such provisions are held invalid by a court with jurisdiction over the parties to these Terms, such provision will be deleted and the remainder of these Terms will remain in full force and effect.
Any failure or delay by us to enforce strict performance by you of any of these Terms or to exercise any right under these Terms and upon such assignment, Deakin Centre for Advanced Food Sciences shall be relieved of any further obligation under these Terms.
Deakin Centre for Advanced Food Sciences may assign its rights and obligations under these Terms and upon such assignment shall be relieved of any further obligation under these Terms.
These Terms and the Privacy Policy constitute the entire understanding between you and us as to your use of and involvement in the Deakin Centre for Advanced Food Sciences Online Portal and supersede all prior agreements and understandings between us and you. Nothing in these Terms shall operate to exclude or restrict your or our liability for fraudulent misrepresentation.
General
The Deakin Centre for Advanced Food Sciences Online Portal is owned by Deakin Centre for Advanced Food Sciences and operated by Compusense Inc., a Canadian company whose registered office is located at 255 Speedvale Ave West, Guelph, Ontario N1H 1C5.
